1. Scope of These Terms

These Terms and Conditions apply to:

• the use of bvbintacademyth.com;
• player registrations;
• trials;
• regular training programmes;
• football camps;
• matches;
• competitions;
• tournaments;
• Academy events;
• BVB eAcademy access;
• team communication; and
• other football activities organised by BVB International Academy Thailand.

Additional conditions may apply to specific programmes, trips, camps, competitions or events.

Where specific programme conditions differ from these general Terms and Conditions, the specific programme conditions will take priority for that programme.

By submitting a registration, paying a fee or allowing a player to participate, the parent or legal guardian confirms that they have read, understood and accepted these Terms and Conditions.

2. Academy Operator

BVB International Academy Thailand operates as a football development programme in cooperation with Borussia Dortmund.

3. Registration of Minors

Most Academy players are minors.

A registration for a minor must be completed or authorised by a parent or legal guardian.

The person completing the registration confirms that:

• they are the player’s parent or legal guardian or are otherwise legally authorised;
• all information submitted is accurate and complete;
• they are authorised to accept these Terms and Conditions on behalf of the player;
• they are authorised to provide the player’s personal information;
• they will inform the Academy of relevant changes;
• they have disclosed relevant medical and safety information; and
• they accept responsibility for payment of the applicable fees.

A child should not independently complete a registration without the involvement of a parent or legal guardian.

4. Registration Process

Player registration is completed through an external registration platform operated by:

Submitting a registration does not automatically guarantee a place.

A registration is normally considered complete only when:

• all required information has been submitted;
• the relevant declarations have been accepted;
• the registration fee has been paid;
• the training fee has been paid;
• payment has been verified by the Academy;
• the player has been allocated to an appropriate age category or team; and
• the Academy has confirmed the registration.

Acceptance may depend on:

• age eligibility;
• available places;
• team capacity;
• training location;
• coach availability;
• programme suitability;
• payment completion;
• health and safety considerations; and
• compliance with Academy rules.

The Academy may:

• accept a registration;
• request additional information;
• allocate the player to another suitable group;
• place the player on a waiting list;
• propose a trial;
• decline a registration; or
• suspend completion until missing information or payment is received.

5. Age Categories and Team Allocation

Players are allocated to an age category or team based on factors including:

• date of birth;
• age;
• sporting development;
• football experience;
• team capacity;
• training location;
• safety;
• competition requirements; and
• the professional assessment of authorised Academy coaches.

Registration for a particular age category does not create an absolute entitlement to placement in that group.

The Academy may move a player to another age category or training group where reasonably necessary for:

• development;
• safety;
• team balance;
• capacity;
• competition rules; or
• organisational reasons.

6. Fees

6.1 Fee structure

The fees consist of:

1. an annual registration fee of THB 2,200; and
2. the applicable training fee.

The amount of the training fee depends on the relevant programme, season, training schedule or registration offer.

6.2 Annual registration fee

The annual registration fee of THB 2,200 includes:

• one BVB football kit consisting of a shirt, shorts and socks; and
• access to the BVB eAcademy.

Kit sizes and availability may be subject to stock availability and supplier delivery schedules.

The Academy may provide an equivalent replacement where a particular size or item is temporarily unavailable.

6.3 Payment deadline

The annual registration fee and the applicable training fee must be paid upon registration, unless the Academy has confirmed another payment deadline or payment arrangement in writing.

A registration is not considered fully completed until the Academy has verified payment.

6.4 Payment verification

The Academy may require:

• proof of payment;
• a bank-transfer slip;
• a transaction reference;
• the payer’s name;
• the player’s name; or
• other information necessary to identify the payment.

Where a payment cannot be identified, registration confirmation may be delayed.

6.5 Transaction charges

Any bank, payment-provider, foreign-exchange or transaction charges are the responsibility of the payer unless expressly stated otherwise.

6.6 Late or incomplete payment

Where payment is not received by the required deadline, the Academy may:

• withhold registration confirmation;
• withhold access to the eAcademy;
• release the place to another player;
• suspend participation;
• cancel the registration; or
• request immediate payment of the outstanding amount.

7. BVB eAcademy and Coachbetter

7.1 Platform provider

Coachbetter is the provider of the Academy’s BVB eAcademy and communication platform.

Coachbetter is not the initial registration provider.

7.2 Access process

After:

• completion of the registration;
• verification of payment; and
• allocation of the player to the relevant age category or team,

the parent or legal guardian will normally receive an automated email containing the access link to the appropriate team or age-category environment.

7.3 Platform use

The platform may be used for:

• team communication;
• training schedules;
• attendance;
• Academy announcements;
• coach communication;
• football-development content;
• exercises;
• educational material; and
• other team-related information.

Users must:

• provide accurate account information;
• protect account credentials;
• use the platform respectfully;
• avoid sharing confidential team information without permission;
• avoid giving access to unauthorised persons;
• comply with Coachbetter’s applicable platform terms; and
• notify the Academy of suspected unauthorised access.

7.4 Availability

The Academy does not guarantee that Coachbetter or another external platform will always be:

• available;
• uninterrupted;
• free from technical errors; or
• compatible with every device.

The Academy will provide reasonable assistance where possible but is not responsible for an outage caused solely by an independent external provider.

8. Refunds and Cancellations by Participants

8.1 General rule

Fees are generally non-refundable once registration has been completed and a place has been confirmed.

Refunds are possible only in exceptional circumstances.

Examples may include:

• a serious injury or medical condition preventing continued participation;
• permanent relocation away from the relevant training area;
• another exceptional circumstance accepted by the Academy; or
• cancellation by the Academy where no reasonable alternative is provided.

8.2 Registration fee

The annual registration fee of THB 2,200 is non-refundable.

This applies even where:

• the player withdraws;
• the player does not attend;
• the player relocates;
• the player becomes injured;
• the player is suspended for misconduct;
• the player does not use the eAcademy; or
• the football kit has not yet been collected.

The registration fee covers administrative registration, the football kit, eAcademy access and related setup costs.

8.3 Training-fee refund requests

Any exceptional refund request concerning the training fee must:

• be submitted in writing;
• state the reason for the request;
• include the player’s name;
• identify the relevant programme;
• include supporting documentation where appropriate; and
• be sent to the Academy as soon as reasonably possible.

For an injury or medical condition, the Academy may request a medical certificate.

For relocation, the Academy may request reasonable evidence of the move.

8.4 Refund calculation

Where an exceptional training-fee refund is approved, the Academy may deduct:

• sessions already provided;
• administrative costs;
• non-recoverable programme costs;
• competition or facility fees already incurred;
• promotional discounts;
• payment-provider costs; and
• other reasonable costs directly related to the registration.

No refund is normally provided for:

• isolated absences;
• holidays;
• school commitments;
• transport problems;
• personal scheduling conflicts;
• missed messages;
• dissatisfaction with playing time;
• non-selection for a match or team;
• voluntary withdrawal; or
• failure to attend.

8.5 Refund decision

Refund requests are considered individually.

Approval of a refund in one case does not create an obligation to approve another request.

The Academy’s decision is subject to applicable mandatory consumer law.

9. Cancellation or Changes by the Academy

The Academy may cancel, postpone, combine, relocate, shorten or reschedule a programme or session because of:

• insufficient enrolment;
• coach availability;
• venue availability;
• pitch conditions;
• unsafe weather;
• lightning;
• flooding;
• excessive heat;
• poor air quality;
• public-health concerns;
• government measures;
• security concerns;
• transport disruption;
• force majeure; or
• another circumstance beyond reasonable control.

Where practical, the Academy may offer:

• a replacement session;
• an alternative venue;
• an alternative date;
• transfer to another programme;
• a credit; or
• an appropriate refund for the affected portion.

The Academy is not responsible for indirect or incidental expenses such as:

• private transport;
• accommodation;
• flights;
• meals;
• lost working time; or
• independently booked services,

unless expressly agreed in writing or required by mandatory law.

10. Player Attendance

Parents and legal guardians are responsible for ensuring that players:

• arrive on time;
• are collected on time;
• attend the correct location;
• bring the required equipment;
• wear appropriate clothing;
• bring sufficient water;
• follow coach instructions; and
• do not attend where illness or injury makes participation unsafe.

The Academy should be informed of foreseeable absences through the designated communication channel.

The Academy is not required to provide replacement sessions for absences caused by the player or family.

11. Health and Fitness to Participate

The parent or legal guardian confirms that the player is medically and physically fit to participate in football activities, except for conditions disclosed to the Academy.

The parent or legal guardian must inform the Academy of:

• injuries;
• allergies;
• medical conditions;
• medication requirements;
• physical restrictions;
• previous conditions relevant to sport;
• accessibility needs; and
• any change that could affect safe participation.

The Academy may require:

• additional information;
• a medical certificate;
• medical clearance;
• modified participation; or
• temporary suspension from activities.

The Academy may refuse or restrict participation where it reasonably considers that participation could create an unacceptable risk to:

• the player;
• another player;
• coaches;
• staff; or
• other participants.

12. Health and Accident Insurance

BVB International Academy Thailand assumes that every player has adequate:

• health insurance;
• accident insurance; and
• any additional coverage reasonably required for participation in sporting activities.

The parent or legal guardian is responsible for verifying that the insurance:

• is valid;
• covers football activities;
• covers training and matches;
• covers treatment in Thailand;
• covers emergency transport where required; and
• is sufficient for the family’s needs.

The Academy does not provide personal health or accident insurance for players unless expressly confirmed in writing for a specific programme.

The parent or legal guardian is responsible for:

• medical costs;
• hospital costs;
• medication;
• rehabilitation;
• emergency transport;
• insurance deductibles; and
• other related costs,

except where liability legally rests with another party.

13. Inherent Risks of Football

Football and related physical activities involve inherent risks.

These may include:

• collisions;
• falls;
• muscle injuries;
• ligament injuries;
• fractures;
• head injuries;
• heat-related illness;
• dehydration;
• contact with equipment;
• contact with other players;
• uneven playing surfaces;
• weather-related risks; and
• other injuries associated with sport.

By registering and permitting participation, the parent or legal guardian acknowledges that:

• not all risks can be eliminated;
• injuries may occur despite reasonable supervision and safety measures;
• the player must follow coach and safety instructions;
• appropriate footwear and protective equipment should be used; and
• participation is voluntary.

14. Liability Disclaimer and Assumption of Risk

In consideration of the player being permitted to participate in football activities organised by BVB International Academy Thailand, the parent or legal guardian:

• acknowledges the inherent risks associated with football and sporting activity;
• voluntarily accepts the ordinary risks reasonably associated with participation;
• confirms that relevant medical and safety information has been disclosed;
• confirms responsibility for maintaining adequate health and accident insurance; and
• agrees not to hold BVB International Academy Thailand responsible for injury, loss or damage arising solely from the ordinary and inherent risks of participation, to the extent permitted by applicable law.

To the fullest extent permitted by law, the parent or legal guardian releases BVB International Academy Thailand, RIS Swiss Section and their authorised officers, employees, coaches and representatives from claims for injury, loss or damage resulting from:

• the ordinary inherent risks of football;
• the player’s failure to follow reasonable instructions;
• inaccurate or incomplete medical information;
• the player’s unsuitable equipment;
• voluntary participation while injured or unwell;
• another participant’s ordinary sporting actions; or
• events beyond the Academy’s reasonable control.

This disclaimer does not exclude or limit liability where liability cannot lawfully be excluded or limited, including liability resulting from:

• fraud;
• wilful misconduct;
• gross negligence;
• deliberate harm; or
• another responsibility that mandatory law requires the responsible party to accept.

Nothing in these Terms removes any mandatory legal rights of the player, parent or legal guardian.

15. Emergency Treatment

Where an injury, illness or emergency occurs, authorised Academy personnel may:

• provide basic first aid;
• contact the parent or legal guardian;
• contact the emergency contact;
• request medical assistance;
• call an ambulance;
• arrange transport to a medical facility; or
• provide relevant medical information to emergency professionals.

Where immediate action is reasonably necessary and the parent or guardian cannot be reached, the Academy may act in what it reasonably believes to be the player’s best interests.

The parent or legal guardian remains responsible for medical, hospital, transport and related costs unless:

• those costs are covered by insurance;
• the Academy has expressly agreed otherwise; or
• applicable law places responsibility on another party.

16. Player Conduct

Players must:

• behave respectfully;
• follow coach instructions;
• comply with safety rules;
• respect teammates and opponents;
• respect officials and staff;
• use appropriate language;
• avoid bullying or harassment;
• avoid violence outside the ordinary rules of football;
• care for Academy and venue property;
• follow team and venue rules; and
• represent the Academy appropriately.

The Academy may take action in response to:

• bullying;
• discrimination;
• harassment;
• threatening behaviour;
• repeated disruption;
• unsafe conduct;
• deliberate damage;
• serious disrespect;
• inappropriate social-media conduct;
• cheating;
• theft; or
• another serious breach of Academy expectations.

Possible actions include:

• a verbal warning;
• communication with the parent or guardian;
• temporary removal from an activity;
• suspension;
• transfer to another group;
• exclusion from a match or event; or
• termination of participation.

Fees are not normally refunded where participation is suspended or terminated because of misconduct.

17. Parent and Guardian Conduct

Parents and legal guardians must:

• communicate respectfully;
• follow venue rules;
• respect coaching decisions;
• avoid inappropriate sideline behaviour;
• avoid abusive or threatening conduct;
• avoid interfering with training;
• collect players on time;
• provide accurate contact information; and
• raise concerns through appropriate Academy channels.

The Academy may restrict a parent’s or visitor’s access to training or events where their behaviour:

• affects player welfare;
• disrupts training;
• threatens another person;
• breaches venue rules; or
• damages the Academy environment.

18. Player Selection and Playing Time

Participation in the Academy does not guarantee:

• selection for a particular team;
• selection for matches;
• participation in every competition;
• a minimum amount of playing time;
• selection for a trip;
• selection for a scholarship;
• selection for training in Germany;
• admission to Borussia Dortmund;
• professional representation; or
• a professional football career.

Sporting decisions may be based on:

• age;
• ability;
• development;
• attendance;
• attitude;
• team balance;
• tactical requirements;
• safety;
• competition regulations; and
• the professional judgement of authorised coaches

19. Competitions, Camps and Trips

Additional terms may apply to:

• tournaments;
• international trips;
• overnight camps;
• visits to Dortmund;
• transportation;
• accommodation;
• visa arrangements;
• travel insurance;
• supervision;
• excursions; and
• special events.

Participation may require:

• separate registration;
• additional payment;
• passport information;
• visa documentation;
• travel consent;
• medical information;
• insurance evidence; and
• additional declarations.

A player’s participation is not confirmed until all required documentation and fees have been received.

20. Photography and Video

Photography and video recording may take place during:

• training;
• matches;
• camps;
• competitions;
• trips;
• ceremonies; and
• events.

Identifiable images used for promotional purposes will be handled in accordance with:

• the applicable consent;
• the Academy’s Privacy Policy;
• the Photo and Video Consent Notice; and
• applicable law.

Parents and visitors must not publish images of other children in an inappropriate, misleading, harmful or commercial manner.

Professional filming, commercial photography or livestreaming requires prior written permission.

21. Intellectual Property

The Website, BVB eAcademy content and Academy materials may include protected:

• text;
• photographs;
• videos;
• designs;
• graphics;
• training materials;
• exercises;
• documents;
• logos;
• trademarks;
• programme names; and
• branding.

The Borussia Dortmund and BVB names, crests, logos, trademarks and brand elements belong to their respective rights holders and are used under appropriate authorisation.

RIS Swiss Section names, logos and materials belong to RIS Swiss Section or the relevant rights holders.

Users may not, without prior authorisation:

• reproduce;
• distribute;
• sell;
• modify;
• commercially exploit;
• upload elsewhere;
• remove branding from;
• or create derivative works from

protected Website, Academy or eAcademy content.

22. Website Use

Users must not:

• use the Website unlawfully;
• submit false information;
• impersonate another person;
• attempt unauthorised access;
• introduce malware;
• interfere with Website security;
• scrape or systematically copy content;
• infringe intellectual-property rights;
• misuse personal data;
• upload harmful content; or
• use the Website in a manner that may damage the Academy, RIS Swiss Section, Borussia Dortmund or another person.

23. Accuracy of Website Information

The Academy aims to keep Website information accurate and current.

However:

• schedules may change;
• fees may be updated;
• venues may change;
• coaches may change;
• places may become unavailable;
• programmes may be cancelled;
• typographical errors may occur; and
• technical information may become outdated.

General Website information does not constitute a guaranteed offer.

A specific:

• registration confirmation;
• invoice;
• programme notice;
• payment instruction; or
• direct Academy communication

takes priority over general Website content where there is a conflict.

24. External Services and Links

The Website or Academy communications may link to external services, including:

• the registration provider;
• Coachbetter;
• payment services;
• Facebook;
• Instagram;
• Borussia Dortmund;
• RIS Swiss Section;
• tournament platforms; and
• programme partners.

External providers operate under their own:

• terms;
• privacy policies;
• security systems;
• account rules; and
• availability conditions.

The Academy is not responsible for an independent third party’s:

• content;
• privacy practices;
• security;
• technical outage;
• account restriction; or
• service decision.

25. Website and Platform Availability

The Academy does not guarantee that the Website, registration system or eAcademy will always be:

• continuously available;
• uninterrupted;
• error-free;
• fully secure;
• compatible with every device; or
• free from third-party technical problems.

The Academy may suspend or modify digital services for:

• maintenance;
• security;
• upgrades;
• operational changes;
• provider changes; or
• circumstances beyond reasonable control.

26. General Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Subject to that restriction and to the extent permitted by law, the Academy, RIS Swiss Section and their authorised officers, employees, coaches and representatives are not liable for:

• indirect loss;
• consequential loss;
• loss of opportunity;
• loss caused by reliance on outdated general Website information;
• third-party platform outages;
• unauthorised third-party activity;
• loss resulting from a user’s breach of these Terms;
• personal property left unattended;
• independently arranged travel or accommodation;
• events outside reasonable control; or
• ordinary inherent sporting risks accepted under these Terms.

27. Personal Property

Players and families are responsible for personal belongings brought to Academy activities.

The Academy is not responsible for the loss, theft or damage of:

• mobile phones;
• watches;
• jewellery;
• money;
• clothing;
• football boots;
• equipment;
• bags; or
• other personal property,

unless the loss or damage results from responsibility that cannot lawfully be excluded.

Valuable items should not be brought to training unless necessary.

28. Force Majeure

The Academy is not responsible for delay, interruption, cancellation or failure caused by circumstances beyond its reasonable control, including:

• severe weather;
• flooding;
• lightning;
• excessive heat;
• poor air quality;
• natural disaster;
• epidemic;
• public-health measures;
• government action;
• war;
• civil disturbance;
• transport disruption;
• venue closure;
• utility failure;
• internet failure;
• labour disruption; or
• another comparable event.

The Academy will take reasonable steps to communicate significant changes and, where practical, offer an appropriate alternative.

29. Data Protection

Personal data is processed in accordance with the Academy’s:

• Privacy Policy and PDPA Privacy Notice;
• Cookie Policy;
• Photo and Video Consent Notice; and
• applicable data-protection law.

A person submitting information concerning another individual confirms that they are authorised to provide that information.

30. Changes to These Terms

The Academy may update these Terms to reflect:

• changes to programmes;
• changes to fees;
• operational changes;
• legal requirements;
• safety requirements;
• provider changes;
• technology changes; or
• other reasonable organisational needs.

The current version will be published on the Website.

A material change will not normally be applied retrospectively to a completed paid registration in a materially unfair manner.

31. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Thailand.

Subject to mandatory consumer rights and any legally required dispute procedure, disputes are subject to the jurisdiction of the competent courts of Thailand.

Before formal proceedings are commenced, the parties are encouraged to attempt to resolve the matter through good-faith communication.

32. Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Where possible, the invalid provision will be interpreted or replaced in a lawful manner that most closely reflects its original purpose.

33. No Waiver

A failure or delay in enforcing a provision does not constitute a waiver of the right to enforce that provision later.

34. Entire Agreement

These Terms, together with:

• the registration information;
• the Privacy Policy;
• applicable programme-specific conditions;
• payment information;
• consent forms; and
• official registration confirmation,

form the agreement concerning the player’s participation.

35. Registration Declaration

The following declaration should be included as a mandatory checkbox in the registration form:

I have read and accept the Terms & Conditions and Liability Disclaimer of BVB International Academy Thailand. I confirm that the information provided is accurate and that the player has adequate health and accident insurance.

36. Liability Acknowledgement

The following acknowledgement may be included separately in the registration form:

Liability and Assumption of Risk

☐ I acknowledge that football and sporting activities involve an inherent risk of injury. I voluntarily permit the player to participate and accept the ordinary risks associated with participation. To the extent permitted by applicable law, I release BVB International Academy Thailand, RIS Swiss Section and their authorised personnel from claims arising solely from the ordinary inherent risks of participation. I understand that this does not exclude liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct or gross negligence.
